2. APPLICABILITY & ACCEPTANCE

These General Terms and Conditions (hereinafter referred to as “Terms”) apply to every visit, (online) transaction, and/or agreement between you (“customer,” “you,” “your”) and The Hack, operating under the name BioHackingCore (“BioHackingCore,” “we,” “us,” “our”). By using our website and/or ordering products via our website, you agree to these Terms. If you do not agree with (any part of) these Terms, you must refrain from using our website and services.

3. MEDICAL & HEALTH DISCLAIMER

OUR PRODUCTS ARE OFFERED AS DIETARY SUPPLEMENTS DESIGNED TO SUPPORT GENERAL WELLNESS AND A BALANCED DIET. THEY ARE NOT MEDICINES AND ARE NOT INTENDED TO DIAGNOSE, ALLEVIATE, TREAT, CURE, OR PREVENT ANY DISEASE, CONDITION, OR AILMENT.

INDIVIDUALS ARE STRONGLY ADVISED TO CONSULT A QUALIFIED PHYSICIAN OR OTHER HEALTHCARE PROFESSIONAL BEFORE STARTING A SUPPLEMENT REGIMEN, ESPECIALLY DURING PREGNANCY, BREASTFEEDING, WHEN USING PRESCRIPTION MEDICATIONS, OR IF THERE ARE ANY MEDICAL CONDITIONS PRESENT.

5. PRODUCT INFORMATION

We offer dietary supplements to support general health and nutritional balance. These products are not intended as a substitute for medical treatment or professional advice. Always consult a qualified physician before starting a supplement regimen, especially in cases of (possible) pregnancy, during breastfeeding, existing health problems, or when taking medication.

Age Restriction: Our products are strictly intended for individuals 18 years of age and older.
Pregnancy & Breastfeeding: Use is strongly discouraged unless you have explicit approval from a medical professional.

Note: The statements regarding our products have not been evaluated by the Netherlands Food and Consumer Product Safety Authority (NVWA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

6. ORDERING & ACCOUNT

6.1 Order Process:
You can place an order on our website by adding the desired products to your shopping cart and then completing the online ordering process. After entering all necessary information and finalizing the payment, you will receive an automated email confirming receipt of your order. The automatic acknowledgment of your order does not yet mean the agreement is final; it is only concluded upon receipt of our explicit order confirmation by email.

You are responsible for providing accurate information. If you provide incorrect information (such as a wrong delivery address), we cannot be held liable for any consequences thereof.

6.2 Account Registration:
You have the option to create an account to simplify the ordering process. You are responsible for keeping your login details confidential and preventing unauthorized use.

6.3 Fraud & Unauthorized Use:
BioHackingCore reserves the right to cancel orders, block user accounts, and inform the competent authorities in case of suspected fraudulent activities, identity theft, unauthorized use of payment methods, or misuse of our services. In case of suspected fraud, we cooperate fully with banks and law enforcement authorities.

7. PAYMENT METHODS

We offer the following payment methods:
– PayPal
– Credit Card (Visa & MasterCard)
– iDEAL
– Bancontact
– CoinPayments

Any transaction fees charged by your bank or payment provider are your own responsibility. We reserve the right to (temporarily) disable certain payment methods for technical or security reasons.

8. SHIPPING & DELIVERY

8.1 Countries & Delivery Times:
– The Netherlands: Expected delivery 1–2 business days
– Belgium: Expected delivery 2–3 business days
Please note that the mentioned delivery times are indicative. Unforeseen circumstances, such as carrier peak times, force majeure, or public holidays, may affect delivery speed.

8.2 Shipping Costs:
Shipping costs are automatically calculated based on your delivery country. We offer free shipping for orders above €50. Once your order has been shipped, you will receive a confirmation email with a possible Track & Trace link.

8.3 Responsibility for Delivery Address:
You are responsible for providing the correct delivery address. Errors in this regard may result in delays or loss of your order. In case of incorrect address details, BioHackingCore cannot be held liable for additional costs or delays.

9. RIGHT OF WITHDRAWAL & RETURNS

9.1 Statutory Right of Withdrawal (14 Days):
As a consumer within the European Union, you have the right to withdraw from the agreement within 14 days of receiving the product, without providing any reason (also known as the “cooling-off period”). You can exercise this right by using our withdrawal form or by submitting an unambiguous statement. For more details, please also see our Returns & Refunds page.

After notifying us of your withdrawal, you have another 14 days to return the products in their original condition and packaging. In the event of a valid withdrawal, you will receive a refund of the purchase amount, including any standard shipping costs you paid, within 5 business days. The refund will be issued via the same payment method you used for the purchase, unless otherwise agreed.

9.2 Conditions for Returns:
– Products must be returned unopened, undamaged, and in their original packaging.
– Return shipping costs are borne by the customer, unless the product is defective or was delivered incorrectly due to our error.
– If an item has been opened or damaged due to your actions, we reserve the right to refuse the return or only refund part of the purchase amount.

9.3 Damaged or Incorrectly Delivered Products:
If you discover that a product is damaged, defective, or incorrectly delivered upon receipt, please contact our customer service immediately (preferably within 5 days of receipt) via [email protected] or our contact form. We will handle your complaint promptly and, depending on the situation, provide an appropriate solution, such as replacement or refund.

9.4 Cancellations:
You can cancel your order as long as it has not yet been shipped. In that case, any amounts already paid will be refunded within 5 business days after cancellation. If the order has already been shipped, the cancellation falls under the right of withdrawal, and the return conditions apply.

10. EU CONSUMER RIGHTS & ONLINE DISPUTE RESOLUTION (ODR)

In accordance with applicable European legislation, we hereby reconfirm your right to a 14-day withdrawal period. If you have a complaint, we request that you first submit it to us via [email protected]. If this does not lead to a solution, you can file a dispute via the European ODR platform: http://ec.europa.eu/consumers/odr.

11. INTELLECTUAL PROPERTY & USER FEEDBACK

11.1 Ownership:
All content on our website (including but not limited to text, images, logos, videos, and software) is owned by BioHackingCore/The Hack or its licensors and is protected by copyright, trademark rights, and/or other intellectual property rights. Without our express written consent, it is not permitted to copy, distribute, edit, or publish (parts of) the website.

11.1a (Addition):
When you post reviews, feedback, or other content (“User-Generated Content”) on our website, you remain the owner of this content. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, publish, and process this content commercially for promotional or marketing purposes. This license remains in effect unless you or we delete the content or revoke the license, to the extent permitted by law.

11.2 User Feedback:
All feedback, comments, ideas, improvements, or suggestions that users provide to BioHackingCore become automatically and irrevocably the full property of BioHackingCore (The Hack). BioHackingCore has the right to freely and without limitation use, modify, copy, distribute, or disclose these contributions, without any obligation to compensate or acknowledge you.

12. LIABILITY & LIMITATION

Our products and services are provided “as is” and “as available.” BioHackingCore is not liable for damages (both direct and indirect) resulting from improper use of our website or products, unless such damage is the direct result of intent or gross negligence on our part.

In all cases where we are found to be liable, our liability is limited to a maximum of the invoice amount of the relevant order. Any (consequential) damages exceeding this amount are excluded, insofar as legally permitted.

12.4 (Addition):
Notwithstanding anything else stated in our General Terms and Conditions, our liability is at all times limited to direct damages up to the purchase amount of the relevant product. Any additional or indirect damages, such as consequential damages or lost profits, are expressly excluded unless mandatory law provides otherwise.

12.1 Indemnification in Case of Misuse:
Users indemnify BioHackingCore and its employees against all third-party claims resulting from non-compliance with these Terms, unlawful acts, or infringement of any third-party rights.

12.2 Force Majeure:
BioHackingCore is not obliged to fulfill any obligation if it is prevented from doing so by force majeure, such as (but not limited to) natural disasters, strikes, epidemics, government measures, failures in communication systems, or other circumstances beyond our control.

12.3 Statutory Warranty:
We guarantee that our products conform to the agreement, the stated specifications, and meet reasonable standards of usability and quality as required by Dutch law. This warranty does not affect your right of withdrawal or other legal rights.

13. FRAUD PREVENTION

In case of suspected fraud, misuse of payment methods, or other unlawful activities, we reserve the right to fully cooperate with financial and/or judicial authorities. This may include sharing your personal data and order details with the relevant authorities and/or financial institutions.

14. APPLICABLE LAW & JURISDICTION

All legal relationships between you and BioHackingCore/The Hack are exclusively governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.

15. FINAL PROVISIONS

Severability: If any provision of these Terms is declared invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision will be replaced by a valid provision that approximates the purpose and intent of the original provision as closely as possible.

Amendments: These Terms may be modified or supplemented by us at any time. We recommend that you consult our website regularly for the most recent version. In case of significant changes, we will inform you in an appropriate manner.

No Waiver of Rights: If we do not always demand strict compliance with these Terms, this does not mean that we waive our right to demand strict compliance in other cases.
